The US State Department has designated Hamas a Foreign Terrorist Organization since October 8, 1997, the EU has listed it as a terrorist organization since 2003 — a listing the EU Court of Justice has upheld on appeal — and the UK Home Office proscribed the group in its entirety in November 2021 after previously banning only its military wing, with Canada, Australia, Japan, and other states maintaining their own designations. These designations carry criminal consequences for support: under 18 U.S.C. § 2339B, providing material support, including fundraising, to a designated FTO is punishable by up to 20 years' imprisonment, and under the UK Terrorism Act 2000, membership and support offenses carry up to 14 years, according to the US State Department and the UK Home Office.
