On 9 October 2023, Gallant ordered a "complete siege" of Gaza — "There will be no electricity, no food, no fuel, everything is closed... We are fighting human animals and we are acting accordingly" (Times of Israel) — a statement South Africa cited as evidence of genocidal intent in its ICJ case, with the Court's 26 January 2024 order taking particular note of his 9–10 October remarks. On 21 November 2024, ICC Pre-Trial Chamber I issued an arrest warrant for Gallant, finding "reasonable grounds" to believe he bears criminal responsibility for the war crime of starvation as a method of warfare and the crimes against humanity of murder, persecution, and other inhumane acts, for intentionally depriving Gaza's civilian population of food, water, medicine, fuel, and electricity from at least 8 October 2023 to 20 May 2024.
